1. Who we are

TrustMarcus is a South African platform that helps sectional title scheme residents, trustees, and managing agents understand their rights and manage their complexes. Our registered address and contact details are available at hello@trustmarcus.com.

2. What information we collect

We collect the following categories of personal information:

• Account information — your name and email address when you register or accept an invitation.
• Role and membership — your role within your scheme (resident, trustee, or managing agent) and which complex you belong to.
• Chat history — questions you ask Marcus and the responses provided, stored to improve your experience and maintain conversation context.
• Documents — scheme documents, rules, or other files uploaded by trustees or managing agents for use within the platform.
• Payment information — billing details processed securely through Peach Payments. TrustMarcus does not store your card details directly.
• Usage data — basic information about how you interact with the platform, such as features used and session activity.

3. Why we collect it

We use your information to:

• Create and manage your account
• Provide AI-assisted guidance relevant to your scheme and province
• Process payments and manage subscriptions
• Improve the accuracy and relevance of Marcus's responses
• Communicate important updates about the platform
• Comply with our legal obligations

We do not sell your personal information to third parties. We do not use your information for advertising purposes.

4. Who we share it with

We share your information only with the following third-party service providers, and only to the extent necessary to operate the platform:

• Supabase — our database and authentication provider, used to store your account and scheme data securely.
• Anthropic — the AI provider that powers Marcus. Your questions are processed by Anthropic's systems to generate responses. Anthropic's privacy policy applies to this processing.
• Peach Payments — our payment processor. Payment information is handled directly by Peach Payments and subject to their privacy policy.

All third-party providers are required to handle your information securely and only for the purposes for which it was shared.

5. How we protect your information

We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, or misuse. These include encrypted data storage, secure authentication, and access controls that limit who within our team can view your data.

No system is completely secure. If you become aware of any security concern, please contact us immediately at hello@trustmarcus.com.

6. How long we keep it

We retain your personal information for as long as your account is active or as needed to provide the service. If you close your account, we will delete or anonymise your personal information within 30 days, except where we are required to retain it for legal or compliance purposes.

7. Your rights under POPIA

As a data subject under POPIA, you have the right to:

• Know what personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your information (subject to legal retention requirements)
• Object to the processing of your information
• Lodge a complaint with the Information Regulator of South Africa

8. Cookies

TrustMarcus uses essential cookies to keep you logged in and maintain your session. We do not use tracking or advertising cookies. You can disable cookies in your browser settings, but this may affect your ability to use the platform.

9. Changes to this policy

We may update this policy from time to time. When we do, we will update the date at the top of this page. For significant changes, we will notify you by email or through the platform. Continued use of TrustMarcus after changes are posted constitutes acceptance of the updated policy.
