These Terms of Use govern your access to and use of TrustMarcus. By creating an account or using the platform, you agree to be bound by these terms. Please read them carefully.
TrustMarcus is a platform that helps residents, trustees, and managing agents of South African sectional title schemes understand legislation, manage their complexes, and access AI-assisted guidance through Marcus, our AI assistant.
TrustMarcus is not a law firm. Nothing on this platform constitutes legal advice. Marcus provides guidance based on publicly available legislation and documents uploaded to your scheme's profile. For matters requiring legal advice, you should consult a qualified attorney.
You may use TrustMarcus if you are at least 18 years old and are a resident, owner, trustee, or managing agent of a sectional title scheme in South Africa. By using the platform, you confirm that the information you provide is accurate and that you are authorised to act on behalf of any scheme you represent.
Access to TrustMarcus is by invitation only. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
You may not share your account with others or create accounts on behalf of someone else without their knowledge and consent.
Marcus provides guidance based on South African sectional title legislation and, where available, your scheme's uploaded documents. This guidance is informational only. It is not legal advice and should not be relied upon as such.
TrustMarcus makes no warranty that Marcus's responses are accurate, complete, or up to date. Legislation changes, scheme rules vary, and AI systems can make mistakes. You are responsible for verifying any information before acting on it. For important decisions — including disputes, enforcement, levy recovery, or legal proceedings — consult a qualified attorney or the Community Schemes Ombud Service (CSOS).
TrustMarcus is a paid subscription service. By subscribing, you authorise us to charge your chosen payment method on a recurring monthly basis at the rate applicable to your plan.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain full access to the platform until that date. We do not offer refunds for any unused portion of a subscription period.
Payments are processed securely by Peach Payments. TrustMarcus does not store your card details. We reserve the right to change subscription pricing with reasonable notice. Continued use of the platform after a price change constitutes acceptance of the new pricing.
You agree to use TrustMarcus only for its intended purpose and in accordance with applicable law. You may not:
When you upload documents to TrustMarcus, you confirm that you are authorised to share those documents and that they do not violate any law or third-party rights. You retain ownership of your documents. By uploading them, you grant TrustMarcus a limited licence to process and store them solely for the purpose of providing the service to your scheme.
TrustMarcus does not share your scheme's documents with other schemes or third parties, except as required to operate the platform as described in our Privacy Policy.
All content, design, code, and materials on TrustMarcus — other than documents you upload — are owned by or licensed to TrustMarcus. You may not reproduce, distribute, or create derivative works from any part of the platform without our written permission.
To the fullest extent permitted by South African law, TrustMarcus is not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of the platform or reliance on any guidance provided by Marcus. This includes but is not limited to financial loss, legal costs, or adverse outcomes in disputes.
The platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from inaccuracies.
TrustMarcus reserves the right to suspend or terminate your account at any time if we reasonably believe you have violated these terms, misused the platform, failed to pay your subscription, or engaged in conduct that could harm other users or the platform.
You may close your account at any time by contacting us at hello@trustmarcus.com. Upon closure, your data will be handled in accordance with our Privacy Policy.
We may update these terms from time to time. When we do, we will update the date at the top of this page. For material changes, we will notify you by email or through the platform. Continued use of TrustMarcus after changes are posted constitutes your acceptance of the updated terms.
These terms are governed by the laws of the Republic of South Africa. Any disputes arising from or related to these terms or your use of TrustMarcus shall be subject to the jurisdiction of the South African courts.
